【Immigration News】DHS Ends Automatic Extension of Employment Authorization

The U.S. Department of Homeland Security (DHS) has issued an Interim Final Rule ending the automatic extension of Employment Authorization Documents (EADs) for certain categories of foreign nationals filing renewal applications, effective October 30, 2025.

Under the new rule, except where extensions are expressly provided by law or through Temporary Protected Status (TPS)–related Federal Register notices, foreign nationals who file EAD renewal applications on or after October 30, 2025, will no longer receive automatic extensions of their employment authorization.

This policy change aims to strengthen screening and vetting procedures, ensuring national and public safety. DHS stated that conducting background reviews more frequently will help prevent fraud and identify individuals who may pose security risks, enabling timely enforcement actions.

USCIS Director Joseph Edlow emphasized:

“It’s a commonsense measure to ensure appropriate vetting and screening has been completed before an alien’s employment authorization or documentation is extended. All aliens must remember that working in the United States is a privilege, not a right.”

USCIS advises applicants to file EAD renewal applications up to 180 days before expiration to avoid any lapse in work authorization or documentation.

Importantly, this new rule does not affect EADs that were automatically extended before October 30, 2025.
